 HRC welcomes abrogation of article 370


HRC welcomed the abrogation of article 370, with which the limited autonomy and special status granted to the state of Jammu and Kashmir is with drawn and bifurcating the state into union territories of Jammu and Kashmir and that of Ladakh.

In this context, it is imperative to mention that the previous state of Jammu and Kashmir is the bone of contention for both India and Pakistan after erstwhile Raja Hari Singh, the Dogra ruler of the princely state formally acceded  to Indian domain on 26th. October 1947.

Pakistan with the support of tribal forces occupied major portion of Jammu and Kashmir, by the time Government of India under Jawaharlal Nehru responded to the situation. Not adhering to the advice of Sardar Vallabhbhai Patel, the iron man of India took the matter to UNITED NATIONS, which is the root cause of the problem.

Nehru's lack of vision, and HINDU-CHINI bhai-bhai slogan did not work. This culminated in chineese occupation of Aksai Chin area in Ladakh region during 1962 war. This added china to the already existing Indo-Pak  dispute. Pakistan strategically acceded thousands of square kilometres of Kara-Koram range of occupied Kashmir in 1963 during the period of Ayub Khan.

The region of Jammu and Kashmir witnessed prolonged insurgency with pakistani backing and a mass genocide of Kashmiri pundits of the valley in 1989. The mass exodus of Kashmiri pundits where citizens of a country becoming refugees in their own country, due to actions of a certain class of people are not acceptable. The recent  talk of Farooq Abdullah, the ex-chief Minister of Jammu and Kashmir for restoration of article 370 with the help of chineese is highly objectionable and tantamount to seperatism and legally unfounded.

People rejoiced, the revocation of article 370 and 35 A. In majority of Jammu region, people held widespread massive celebratory demonstrations over several days with the bursting of firecrackers, dancing, and distribution of sweets,. In Ladakh, the Buddhist organizations welcome the deletion of Article 370 provisions and make the Ladakh region a separate Union Territory. The persons in Leh and Matho welcome 15 August as a day of independence from Kashmir and celebrated their Union Territory status.

Revocation of the special status of Jammu and Kashmir encompasses changes in the politics and bureaucracy of the region, priority of counter-insurgency operations, new domicile rules and decline in stone-pelting.

Revocation of article 370 enable people to acess various welfare schemes such as Right to Education, Right to Information etc.. which were previously denied. Revocation of the article 370 was passed by a prifusing majority in the parliament and is constitutionally and legally valid and sound.
